The agreement between PAYTONMAIL and the individuals who hold a membership.

A PAYTONMAIL membership is a personal, non-transferable licence to use the service. Membership is offered at our discretion. We may decline to renew a membership; we will not terminate a membership in good standing without notice and an opportunity to export your data.
Membership is billed annually in advance. You may cancel at any time and receive a prorated refund for the unused portion of your term. Prices are quoted in US dollars and exclude any local taxes for which you are responsible.
You agree to keep your account credentials secure, to provide accurate information for billing and recovery, and to use PAYTONMAIL in accordance with the Acceptable Use Policy. You remain responsible for the content you send.
We will operate the service with reasonable care, notify you of incidents that affect your account, keep your data confidential as described in the Privacy Policy, and respond to requests for support in a timely manner.
We target 99.95% availability measured monthly. Where availability falls below this threshold, we will credit a prorated portion of your membership for the affected month on request.
Either party may terminate this agreement with 30 days' notice. We may terminate immediately for a material breach of the Acceptable Use Policy. On termination, your data is exported on request and permanently erased within 30 days.
To the maximum extent permitted by law, PAYTONMAIL's aggregate liability to you for any claim arising from this agreement is limited to the membership fees paid by you in the twelve months preceding the claim.
This agreement is governed by the laws of the State of New York. Disputes shall be resolved in the courts of New York County, except where applicable consumer protection law grants you the right to bring proceedings in your local courts.
